You will know for sure if you file your taxes electronically (either yourself or through a preparer), and it gets rejected because of two people claiming the same SSN. If this occurs, then that doesn't mean you can't claim your child. As long as you are legally entitled to claim your child then you may still do so on a paper tax return. Anyone who is fraudelently claiming someone on their tax return will be held accountable one way or another. If it is not sooner, then they will be later. All you need to be concerned with is whether or not you are doing everything according to the law. As long as you know that you are then there is nothing to worry about. Your refund maybe delayed by a few weeks but you will get it as long as you do everything by the law.

Yes you can Latrice, go to the Social Security Office with your childs SS# in hand and ask them to pull up his record . If you have to prove that you support him just remember, "You must provide over 50%of his support, that is housing, food, clothing, etc. etc. Good Luck.

Go ahead and claim the kid, if you're sure that you and only you are entitled to it. Then you will both be audited, but then you can prove that you're allowed.
