My mother is living with me and has been in and out of jobs all year, her total income is about 9-10,000 MAYBE. Can I put myself as head of household since I am paying all bills and rent? (she is 53)

No, you cannot claim yourself as a head of household because you cannot claim your mother as your dependent. To be considered as your dependent, besides other tests your mother has to pass the gross income test, which requires the dependent's taxable income to be less than the exemption amount ($3,300 for 2006). Unless your mother's income of $9,000-10,000 is tax-exempt such as interest on municipal bonds, you cannot claim her as a dependent. Sorry.

Her income is too high for you to claim her as a dependent. Since she isn't your dependent, you can't file as head of household.

You should be able to, you are supporting her,she is living under your roof..
