If your child is living with your father and your father had adjusted gross income less than about $36,000 for 2006 then it may be possible for him to claim the EIC for the grandchild.

If the child is a qualifying child for you for the EIC, then you have priority in claiming the credit. You would need earned income under about $36,000 as well, and live with the child.

If you're talking about his 2006 return that he'll be filing in the next few months, then his 2005 income would not affect that.

But $50K income for a given year is too high to get EIC for that year.

NO, he has earned too much money and might have to pay instead of receiving money. Earned income credit is usually for people of low income.

i think that for the earned income credit you need to make below a certain amount. go get one of those tax books from the post office. it will tell you everything you need to know.
