So, how do they debate how much to take from your taxes? This is the first year I am filing single after a divorce and we owe back taxes, they dont go after him primarily, but take both of ours? I am just wondering how they come up with how much to take from you

You need an accountant and he or she needs to be fully briefed on your circumstances.

This is not a job for H & R Block (there are some there who could give you good service but you are not guaranteed to get them!)

There are ways to get relief, but it is best not to listen to laymen, unless they are telling you to seek professional advice. Make an appointment to see a CPA (or Enrolled Agent) quickly. We are about to get insanely busy.

If you filed a joint return during the time you accrued back taxes, then each of you will be considered liable for the full amount.

The IRS doesn't care which one of you pays them, they will take whatever refund either of you gets in order to pay the back taxes.

If you believe you should not be held responsible for some or all of the back taxes, you should file Form 8379 with your tax return. This is a request to allocate the back taxes between the spouses.

They could take your entire refund if one is due.
Better get with a tax accountant on this as you could potentially have an out. You don't provide enough information to determine this in this forum, but a tax accountant should guide you.

Employers use tax tables issued by the IRS and the state to determine how much to withhold. Most of the time this is automated in their payroll system, but the IRS and state tables are still used.

It's not a "debate".
