If you are jointly responsible, they'll take your refund too whether it's a single return or not.

If you filed jointly, and the Feds placed a lien on you, then both of you will be liable for the debt and they can take your return. If you believe this is the case, I would suggest you get a personal loan from Prosper to pay the tax debt. If you feel that this was incurred because of the ex-spouses financial abuse, you can claim Innocent Spouse, but you will have to hire a tax lawyer to get this to stick.
