I had a new patio cover installed on my screen room. It has leaked four times already (with every rain). The company has been out three times already to attempt to repair it with no avail. It is leaking bad. It floods the floor of my room and I have lost some stuff that I had to throw out from getting wet. Also, the compnay split my fascia upon installing and put caulking all over my brand new roof. Since, they can't fix it, I did not know if I should call my insurance company to file a claim because I obviously need a new cover. I just paid $4800 for this one a little under three months ago. I have photos and was planning on sending a certified letter to the company demanding they fix it this time or I will contact the BBB and take legal action. I am just worried that this will make them mad and they won't come out to fix it.

You can FILE the claim, but faulty workmanship isn't covered - so you're not likely to collect.

On the other hand, they MIGHT help you sue the contractor. Your structure claim needs to be paid by the guy that installed the patio cover.

Seeing as how they AREN'T fixing it, I don't see how making them mad so that they won't fix it, is going to put you in a worse situation than you are in right now.

Meanwhile, stop putting stuff that can be damaged in the screen room. And you'll have to do something about drainage for it - I'm guessing the floor isn't level all the way, or should be draining AWAY from the house, and isn't. You might consider having french drains installed right by the floor.

The company that installed the cover is responsible for the quality of the cover. If you cannot get them to fix it, your recourse is to sue them for the damages. This would involve going to court and perhaps hiring an attorney, depending on the level that is termed small claims in your area. You may be able to recover your costs, but you will probably have to hire a new contractor to gte the job done. If they have not been able to fix it after three visits, chances are they are not going to be able to do it. Don't worry about making them angry. They did the bad job.

You should not file an insurance claim for this on your own insurance policy.

You should consider not even going the BBB route and a threatening letter.

You need to be forceful with the company....ask them to fix it right this time...if they don't...tell them you are going to ask them to pay for somebody else to do correctly.

If you file a claim with your insurer.....not only are you going to have to deal with your deductible, lessening any potential payout.....but it may be questionable whether you can even make a claim because of the shoddy workmanship exclusion in most property insurance policies.
If you do get a payout....your insurer may end up sending you a notice of potential non-renewal....which means they will drop you if you submit another claim.

So...why bother with your insurer.....go after the contractor and his insurer.
