I rent a condo and just had a smoker move in below me..it reaks with smoke now in my condo...is there anything I can do legally or anything I can do to alleviate the situation? I don't want my condo to smell like smoke all the time and now it does!! Thanks for any ideas....

Move. The nice thing about single family homes is that you don't have to put up with things you don't like. Condos, apartments, duplexes - unless deed or lease specifies restrictions or restrictive covenants protect the other tenants as well as you.

Who lived there first? If his lease or restrictive covenant does not forbid this then he is grandfathered, even if new restrictions are added.

He 's a renter too right? Do you have the contact info for his landlord? If you don't I'm sure a neighbor might know who owns that unit...ask around quietly ! If you do I would start by contacting his landlord and ask if he can ask his tenant to smoke outside?
The smoker is most likely unaware that you having these problems with their smoke. I would not directly ask this person anything as most people are easily offend. Often times when they know something get's on your nerves they are more apt to keep doing the offending behavior.
You could also threaten the owner of that unit with a small claims court law suit. You could say you need the funds for special cleaning and dry cleaning of your clothes or if you find a filter machine or device you could sue the landlord of that unit to pay for it ? Unit owners make small profits with their renter's so making them pay for things usually gets them to correct their tenant's behavior.

Check your lease/rental agreement and see if there is anything in there about smoking. There may be, if not invest in one of those expensive air purifiers. They look like tall fans, and work well for second hand smoke and odors.

Maybe you can ask the owner/landlord if they can construct some type ventilation in the smoker's place so you don't have it coming up to your space.
