lets say my neighbor invited his friend to his appartment and they start to pictochat. then im in my room and I go to pictochat, because we are close to each other, will there be a connection so I can chat with them?

well it depends how far away your apartments are, (most likely you will) the microphones are for games that use it like wario touch, brain age, etc. and if they are playing a ds download play game and they start a battle then yes you will

You can be in the same pictochat room if you choose the correct one. It will say how many people are in it. Since I believe your neighbor does not live very far away, you can enter their conversation.
The microphone in the DS is for some games where you must speak or blow. This is in Yoshi touch and go, Nintendogs, and Wario Ware touched.
You cannot download the game they are playing. The only way to download a game is at a download center, most likely at a store.
You can do DS download play and depending on the game, have a multiplayer battle in almost every single DS game. If they are enacting the DS dowmnload play, you can enter the game if you search for a game to play At the right time.

The microphone is used for other games that require some form of speech.
The limit of the wireless connection thingy [ for pictochat or whatever] is around 10 metres? So as long as you don't surpass that distance apart you should be fine.
Yes you should also be able to download games while they are playing [ if you are within distance]

It depends on how close you are but it should work.
The microphone is used by some games. For example, you teach your dogs some voice commands in Nintendogs. Or you can voice chat online with Metroid Prime Hunters. (though most games just have you blow into it...what a waste)
And if you are close enough to pictochat then you are definately close enough to do download play.

the chat range is 65ft or closer. when u r playing WiFi, u can get a mic and talk to other people. you can download a sample of the game so u can play it. even if u dont have the game.
