I moved into an apartment with a friend in the fall. She failed to mention to me that I would have to share the room with her until she had already agreed on the apartment (she set up the apartment in the west while I prepared to move). Her friend also moved in with us, and she brought along two cats that she has been illegally harboring in the apartment. The cats have fleas that we have not been able to get rid of--I get bit constantly--I have done everything (advantage, flea powder, fumigation) to no avail. My roommates don't mind the fleas and they haven't noticed/cared that the pilot light on the heater is out and we remain without heat (I can't take work off to deal with PG&E). I am fed up, how can I get out of this lease (which we all separately signed) without reporting the cats? I am angry, not evil, but I have reached my limit. I came home today from holiday and the cat had peed on my sheets which they had leant to a friend--enough it enough!

The lease states: "Tenant (s) will not let or sublet or assign the whole or any part of the premises to anyone for any purpose...without written consent from the owner...and the # of persons to occupy said premises shall not exceed the undersigned...only without prior written permission from the Owner. Furthermore, any let, sublet or assignment will be void."

There is also a fee of 50 dollars for any roommate change, which is no problem for me to handle. The landlord is a sweet old lady I have yet to meet who I suspect is getting on in years a bit. There is also a super that speaks no English. It is not the idea situation.

I am afraid that I will be stuck living here. I have already been bitten hundreds of time by these fleas and I have simply had enough, my roommates are rude and noisy (I work early and must be asleep by 11) and we are stuck sharing a one bedroom apartment. The windows are one plated so not having heat is bad. I can see my breath in the kitchen.

IF you can show me a copy of the contract or type it up I would be able to offer some suggestions. THe only two ways that I know of as of right now is if you are able to sell your remaining lease to another person or find out that there is a violation of the contract(for exmpla the heat not working). Also if the heat isnt working and even after you report it, it remains broken then you can move out saying that it isnt livable. Another option is to talk to the management and see if they will let you move out with just a month penality or some small fee instead of ALL of the months remains. You're screwed unless your roommates A. Kick you out. B. you find someone to take your place that your roommates agree to. Or C. Tell your landlord and hope to get evicted.
Also you could just tell your roommates that you are not happy about the flea situation and living conditions.
As far as the pilot light..all you need to do is call your landlord to take care of it...that's why you pay rent. Also...maybe if your landlord comes out to fix the pilot light..He will notice the cats..win win situation.

The cat peeing on your bed..Id have a fit! The owner of this animal is obviously not very responsible. You are going to have to confront your roommates...That's what I would do. Other wise just settle in for 9 more months of hell. Its up to you to decide how to proceed. Good luck!

I would probably start by talking with your friend and tell her that this is not what you agreed to do and tell her that her friend and cats will have to go or you will. If that doesn't work tell the apartment people about the cats and tell them you want out of the lease. They may be able to put you in an apartment by yourself or some may even help you find a roommate, if that is what you want. I would not put up with that for a minute.

1st go to ur landlord and make a complaint whit him/her about it. If ur landlord dont do anything then u can legaly get out of ur lease and ur roommates will get stock with the ballace of the lease But to get out of a lease U wont to pay the fine thats in ur lease. Or court.

Get rid of the cats,Fumigate outside and under the house.Her friend should go with her cats.You were there first.Oh well women always win so get used to it.

Give 30 days notice of breach of lease have it notarized and sent to the leasor by certified mail include a list of reasons for breach of contract and bail out........make sure you get any utilities out of your name
