"They should say our own government cannot protect us. America is better because they can protect their criminals."

This quote was uttered by the victim in the Nicole-Daniel Smith rape case today after she was informed that her assailant was allowed to head for the US Embassy after his conviction.

Lesson number 1
Filipinas, do not drink too much! You are not guys, you are WOMEN! and do not go out with Americans, foreigners or any strangers if you are drunk as hell.

Lesson number 2
Friends? You are supposed to look after your friends much more if she is your relative. If you see your friend is already drunk, you should have intervened and said she needs to go home now. She is your RESPONSIBILITY!

Lesson number 3
Americans and foreigners, your constitution does not follow you! Know the local laws and culture to avoid getting in trouble. According to Philippine laws if you have sex with a woman who is deprived of reason or unconscious (under drugs or intoxicated) it can be considered as rape. The Philippines has the most extensive rape law in South East Asia and probably in the entire Asian region. READ the weblink below!

In the first place, what was she doing in Subic when us marines have their rest & recreation. She's from far away Zamboanga. It was because she was dropped from the rented van half-naked and embarrassed that she want revenged.
But of course those idiots should have accorded her human civility and dignity when they rushed to their ship before the lapse of curfew hour.

The Philippine Constitution is very specific, that it adopts international laws as part of the law of the land. The VFA is an agreement to both countries and ratified by Congress. The government cannnot do away with it but abide by its provisions.
The judiciary will have to take cognizance of that agreement.

The victim won the first base. But the case has not yet been resolved when an appeal was filed with the higher court. And it won't be through until the Supreme Court say so. This is the available remedy taken by the us marine.

This is Philippine justice system. Even the convicts are afforded rights. The victim need not sour-grape against the government, for this all started from her own wrongdoing.

If the agreement between the U.S.A. and the Philippines covering visiting troops is not honored it will have a far more negative effect on the Philippines than the U.S.A. The International Community is watching.

It is widely accepted by the financial community around the world that the Philippine people are immature when it comes to laws, treaties, legal contracts and their own Constitution. The Philippine people tend to ignore laws, treaties, contracts and sections of their own Constitution they do not like.

They are a Third World Country not because they lack in natural and mental resources. They are a Third World Country because they lack in maturity. The Philippine people are easily led into the streets to protest anything and everything because they follow their emotions. Foreign Investors do not want to risk investing their funds in countries that ignore treaties, laws, contracts and their own Constitution.

Foreign Investors want to know the rules before they invest and do not want the rules changing based on the peoples emotional state at the moment. The new unopened International Airport in Manila, the oil leases that were recently cancel, the land the government had plan to confiscate from the resort owners, the railroad agreement with China, mining investments, etc. are all examples of contracts entered into by foreign investors in good faith only to find the rules changed after the ink on the contract dried.

I recently heard a representative of an International Company that has been doing business in the Philippines since 1917 say "A Philippine contract is not worth the paper it is written on. Anyone is a fool to invest more than they can afford to loose in the Philippines. Your venture may be successful and because it is successful you may find the contract ignored and your Philippine partners pushing you out."

Corruption is a contributor to most of the problems in the Philippines and I believe corruption in the Philippines is the results of a colonial mindset and immaturity when it comes to a democratic mindset.

Many in the Philippines may be seeing the Smith case as the U.S.A. over powering the Philippines, but most of the world is seeing it as the Philippines failure to honor an agreement and allowing their emotions to blind them.

I am for Smith serving his time in the Philippines. I would rather the Philippines support him while he is incarcerated than U.S. Taxpayers. I am not for the Philippines ignoring their agreement and adding to the perception Filipino's cannot be trusted and my mature honest Filipino freinds paying the cost.

Sad to say.... i agree with that statement.... but i disagree that a US prisoner will be given to their embassy..... thats unfair!!!
i have been working before in the Death row doing some counseling with the people there and i know the situation of our prisoners..... so i feel really sad that they give special treatment to foreign (especially American) prisoner. He has to exprience what is hell here on earth too.... like our prisoners... how i wish i am Bill Gates so that we can have a better prison cells for our KAbabayan suffering there!!!

Well, OJ Simpson got away didn't he?. That's American justice.

Let's all join the U.S. military. We can do all the raping we want in some backward third-world country. And no one can ever touch us for our deed!!

What would the Americans say if I visit the U.S. and rape some American woman, then tell them I should not go to jail because it will violate some dumb agreement??.

All I can say is: "If you don't want to do the time, don't do the crime", VFA or no VFA. It's more of a sign of immaturity to use VFA to shield somebody for raping, murdering, or any other crime.

As an American living in Philippines, I agree with her statement. It looks like Gloria's kidnap gang pulled off another one.

This statement is oozing with sour-graping and stated like a little child who lost her candy to another kid.

The "alleged" rape victim's real name is Suzette M. Nicolas..who was trying her best to hide her real identity for many years when the Philippine court announced it in full glory in front of the media at the sentence-reading.

And this is what you call efficiency in the Philippine system? The Philippines signed an agreement with the United States. And the Filipinos must show some dignity by honoring agreements and compromises. Just like a mature human being.

i think it's true, if you have seen some reports by the media, that even in our own, you'll see the prisoners are packed like sardines in a small jail. some of them are sleeping in the floor, not enough space, if a prisoner gets sick, the others will also get sick. if you're a VIP, a congressman and a mayor in jail, you will get privileges, like your own A/C unit and some luxuries.
