Report it now , it might be some little known fact that it really does belong to you! If not you've done the right thing by reporting it now so that there won't be consequences later.
Honesty IS always the best policy.

The best thing is to put the money in your bank account and then call them the following day. They may say that there was a mistake on their part. And that money is part of the past checks and that is the money they own you..And if they say that the money was sent you by mistake then just send them the money back..Just trust me call them, and if they have no answer and you spend the check all they will do is take part of your check every month until it is paid back ..

Did you pay for something yourself in the past that should have been covered under SSI?Such as a doctor bill,a lawyer fee or another expense for your son?Could be they are paying you back for something. To be safe,I would call them and inquire before you spend the money and then have to pay it back if it was a mistake.

I hate to tell you that the got has no earthly idea what they are doing. When I started getting my checks..it went like this. I woudl get a few checks with letters saying they recalculated my amount due and underpaid me..a few weeks later, i would get a letter that says they OVERPAID me..a few weeks later, another check..they underpaid me.. It took almost 3 years for them to get it right... Don't be surprised if they ask for it back in your monthly checks .

I would ring, if you are getting too much money it is likely they will find out eventually and you will end up having to pay back the extra which is always going to be pretty stressful.
If you ring them and you are getting the right amount you can keep taking the money guilt free!

You are wise to question the legality. They may well be legally due him but you cannot fail to contact them and inquire. Who knows, maybe this is a trick to see how honest you are. The government SS and SSI always eventually catch up and you don't want to pay the interest if it comes back to haunt you. Good luck.
