Well, lets be honest, even DNA testing depends on having a clean source to compare with, so the US THINK the've had him locked up since whenever they decided they knew best and invaded Iraq, only so much you can test when you are blind!
Also, whos to say it wasn't a double or rigged and he is actually still alive in a US "prison" being abused by bored CIA agents when they have nothing better to do than read your paper from space when you're having your coffee?!
On a more serious note, anyone who has seen Team America will know how easy it is to disguise someone! :P
