According to the website below, the ring is seen as a gift if three things can be determined; 1) the donor's intent to give the ring as a gift, 2) the donor's delivery of the ring to the donee and 3) the donee's acceptance of the item. If all three of these things are present then courts will often determine the ring is a gift.

I would, however, look carefully at this website as some courts have considered engagement rings to be a conditional gift and that changes many things.

An acceptance of a ring is saying yes she would marry but if things change and she doesn't want to marry him then most judges consider it like a contract and she has to give it back now if she marries him and they divorce she can keep it because she went through with the marriage. So good luck I would give the ring back and save time in the court room.

THe ettiquette is that if your Mom broke the relationship she gives the ring back. If the guy broke the relationship, your Mom keeps the ring...in either case why would your Mom want to keep the ring unless it was just for spite....

The proposal, along with the ring, is a contract. If he broke the contract, the ring is hers.

No, because the ring was a gift of MARRIAGE and ENGAMENT! Is she doing that no? The man should reuturn the ring, it's his money not your mom's! She only gets to keep it legally if she marrys him. It's a gift, not for just saying "no, but I'll keep ring, thank you!" No SLUT would say that!

The ring was a promise to marry. If SHE broke the engagement, she must give it back. If HE broke the engagement, she doesn't have to give it back, but why would she want to keep something he gave her in preparation of marriage?

I wouldn't want to keep the ring. I think that is in poor taste. He probably spent a lot of his hard earned pesetas on it. Give it back. You will get another when the real man comes around.

The ring is not a gift outright, but a gift in expectation of the marriage. No marriage, no gift. Return the ring.

Legally it depends on who broke off the engagement. If she broke it off or caused it to be broken then she must return it, If he broke it off just because then she is free to keep it.

By caused it to be broken I mean if she was caught seeing someone else or gave him another valid reason that he had to break it off.

i don't think so. engagement rings are part of a verbal contract that she agreed to marry the guy. if she's not going to marry him now, the ring should go back.
