does the drug test go to a state lab or done right there in the hospital?

In Oklahoma, if you are the driver involved in a fatality collision, then yes a blood test is mandatory by Oklahoma law. If the driver was sober it also protects the driver in the event of any civil action that the family of the deceased may file in the future.

The officer takes a state blood kit to the hospital and a registered nurse draws the blood. The officer seals the kit and sends it to state investigations lab. The officer then takes the case file to the District Atty's office in the county where the accident happened. It usually takes 6 weeks to get the results in. When the results come back they are forwarded to the District Atty's office and it is then determined if charges of manslaughter or vehiclular homicide are filed by the District Atty's office.

insurance company's need test results to know weather to pay claims or not so yes usually testing is done if suspected that the driver was "altered" but other wise not.where the test is processed depends on which hospital you are in. some dont have labs some do.but samples are taken from the driver eighter at the scene or in the hospital.

If the officer at the scene of the accident thinks you are under the infuence, yes, there would be a drug test.
The blood or urine sample is taken at a hospital and sent to a state lab for testing.

First of all.... Everybody else is full of crap. Listen to me here right now, I'm giving your pearls of wisdom. I was a cop for 21 years. I investigated literally thousands of traffic accidents and that why they call them ACCIDENTS! It can happen to anyone. Sometimes people get killed. That doesn't mean that alcohol or drugs were involved. EVER! You could be sober as Mother Cabrini and still have an oops moment where someone gets killed. It happens. So no a drug test is NOT REQUIRED unless there is probable cause to suspect that drugs were involved.

yep they just take a blood test! can be done either place. They took my dads when he went off a Cliff in Saugus Newhall California Lucky he had not been drinking that day all indicators showed he was run off the road off a 500 ft Cliff. So the insurance paid off.
If they The cops suspect they will get a court order and have them do it wither dead or alive. Usually smell or eyes being dilated. Showing probable cause.

It is usually done in the hospital and sent on to the state w/results , however it all depends on the state/city as to how preformed. usually in hospital
