She can do nothing. Do you think for one minute Mexico will cooperate with the US on a custody issue?
She better take her children and go as far from him as she can...then turn him in to the IRS for failure to pay taxes...they deport faster than anyone....

He got here illegally and he can take the children and run to Mexico where they cannot be retrieved - no extradition there because the father did not commit a crime. If he is the bio dad and can prove it via DNA and the mother is an abuser, neglectful, a drug addict, etc. and the courts remove the children, he can petition the court to let him take them to Mexico and he may well get such an order. The mother is clearly irresponsible because she has children by a Mexican National, without marriage I assume, and she picked so poorly that he is now threatening to take the children - she knew what she had when she was having intercourse, she knew what he was and she was willing to risk the wellbeing of innocent children (more than one?) to keep "a man." Relatives should intervene and get legal control over the children and don't let them get out of eyesight.

No. The children are American citizens. If he were to take the children, it is kidnapping. It is very difficult to retrieve internationally kidnapped children. What she needs to do is be prepared BEFORE he can get the chance to steal them away. She needs to report his threat to the police, and immigration, and NOT let them out of her SIGHT! It will be very costly for her financially, as well as emotionally, if she takes no action, and he intends to keep them hidden. Usually when someone doesn't want to be found, they won't be. EVERY threat he makes, or has made needs to be documented, and recorded if possible. Preventative measures are more successful, than measures taken after the fact. I wish her faith, and fortune.

The mother has every right to keep them in the US, to better their lives, but if the father is in Mexico, don't let the kids go over or entrust them to anyone who might deliver them to Mexico. The US does have good relations with Mexico concerning this issue, your lucky the kids did not find their way to Saudi, where the mother has "NO" rights what so ever. The father does have certain rghts, but if he can not legally come to the US, don't let the kids go there.

If his illegal why doesn't she just turn him in. If he get's his kids across the boarder she will have a very difficult time getting them back, if she even does get them. She will have to get them back the same way he got them over there, sneak them back over and then get as far away as she can. He will look for her until he finds them again. But she should turn him in and she best get her one heck of a good lawyer so he will have a very hard time getting back into this county.

The mother could just call the police. The children are American citizens.

Had an old friend who dealt with this situation across state lines, but not national borders. Answers you already got seem to follow the norm.
Here is a good resource we got from working with family agencies:

Tell her to take the kids and run!! Not only will Mexico not do anything, but why take the chance in allowing your kids to be raised there!

Don't ya just love the mess our political system has created because they simply don't want to enforce the laws our representatives pass on our behalf. Ya gotta just love people that break our laws.
