There are 2 kinds of absinthe, that made with the hallucinogenic wormwood and that made without. The stuff made with is illegal in the states, that made without is fine.

In the US, absinthe is _probably_ legal to own for personal use. The uncertainty derives from conflicting US Customs, FDA, and DEA regulations. Government rules, confusing? I know, what a shock.
It's definitely illegal to sell it for human consumption in the US, so you'll have to purchase it from stores outside the US. Even this doesn't guarantee a delivery from the FedEx guy because, according to Wikipedia:
"Absinthe can be and occasionally is seized by United States Customs if it appears to be for human consumption and can be seized inside the U.S. with a warrant."
It's very doubtful anyone will come to your door and arrest you for owning a bottle of absinthe, but it's always possible. So, you pays your money and takes your chances. Good luck!

Short answer: in the U.S., NO.
It's based on the thujone content after the distillation process. A search on wikipedia for "Absinthe" will give you a page with ample information, also with links to sources for the FDA regulations regarding thujone content as a food/drink additive, as well as search and seizure protocols against importing.

Technically the ingredient wormwood is whats illegal about it. It contains the drug thujone which is the supposed hallucinogen. That makes real absinthe illegal in the US. However, you can find some fake versions which substitute the wormwood.
