balance owed. We have 2 kids and she doesn't make nearly as much as I do. How can we maximize our return?

If she files separately, then her refund will not be taken for what you owe. You can even file joint and she'd still get her share of the refund if she files an injured spouse form. Filing joint would probably maximize your return.

Without knowing how much your wife makes, it would probably be in your best interest to file together as "Married filing jointly" and filed form 8379-Injured Spouse Allocation. Pretty much what this form does is calculate your tax as if you filed separately. Filing this form will delay your refund for weeks, sometimes even months. So be prepared to wait for it. Good luck.

If you have ever filed together before, you cannot file seperatly now. Its messed up I know but listen to this...a friend of mine and her boyfriend (boyfriend not HUSBAND) filed jointly one year and the next year, they went to file separatley and they were told that once they filed together (married or not) they would have to get a legal divorce before filing alone. Screwed up huh? So they would have had to get married and divorced to ever file alone again. Government has wacky rules huh?

let your wife file for the kids you would get more

file seperately and you may even have to lie a little and say that you have not been together for a while. I believe it is 3-6 months.
