Any person can have a brother in-law if they have a sibling that is married. For example, my sisters husband is my brother in-law. This makes no difference if I am married or not.

no he doesn't - a brother in law is either the brother of your spouse OR the spouse of one of your sisters. So, if he is single and has a brother-in-law that would mean he has a sister who is married.
