I was never illegal I was brough to this country when I was 1 and my mom and dad are american citizens but I never figured I would have to become 1 since my parents were...a crime was committed when I was a teenager and did serve my penalty for that crime and completed a life parole in 4 clean trouble free years....got into trouble again cause my wife was having an affair so I threw away 10 clean sober trouble free years and started using drugs once again which led me to voluntarily leave the states so that my children wouldnt go through any more hardship....all 3 of my children are currently with me and have been for the past 3 years and I have been supporting them with out any help financial or other wise from my cheating ex-wife...I ask again would you grant a person like myself another chance at living in a country that is the only place they know as HOME??

So its not a matter of being deported, rather being refused re-entry? How long were you outside of the USA? More than a year?

Lets face it, you are highly unlikely to get any useful advice in this forum. you have a difficult situation. All I can suggest is to engage an immigration attorney and appeal. Do it as soon as possible. I know they cost money, but if it really is what you want, I hope you will be able to find a way.

The simple fact is that the USA is entitled to admit (and deny) whomever it wants. Based on what you have said, you most likely fit the criteria for an almost-automatic denial.

Sounds to me like you have made a few bad decisions. Sorry to hear that. Of course you deserve a chance to make your case.

I am sure if your parents helping you was an option you would have mentioned that.

I would say start writing letters. To your former Congressperson, Senator or any public official who can potentially assist you. I would include letters of reference in regards to your character for the man you are today. Employer, clergy, counselors, anyone that can show that you are a responsible person. If your children were born in the US then they are citizens and if you have legal custody of them that should mean something.

I can't imagine what you must be feeling right now. Feeling like you are a part of a country yet not being legally a citizen of that country.

PS... Joe I'll apologize for the person below me. I am not sure what made this person judge and jury to decide whether your children deserve to stay in *their* country with *their* father.

Refugees from Darfur should have the right to be here over citizens of this country? Excuse me, I am sorry that the people of the Darfur region of the world are enduring what they are but that does not mean that they have any right over citizens of this country. This mans three children are citizens of the United States, they were born here, this is THEIR home. They have as much right as you, me or any other citizen of this country to spend their lifetimes here. This man made a few errors in judgement. I suppose you have lived your life free of mistakes. Last time I knew there was only one person who ever was perfect and could walk on water. You may want to keep that in mind the next time you pass your irrational judgements.

If your parents became citizens when you were a small child, why don't you have derivative citizenship? I don't understand all the ins and outs, but if your story is true you should look into it.

As to the rest, there are a lot of people who want to come here that have managed not to commit crimes and use drugs. I frankly don't think that even if you are rehabilitated (and backsliding for personal problems isn't a good sign that it would stick) that what you deserve for it is citizenship here. Your parents created the problem if your story is true, but you sure put your own stamp on it, as well.

Sorry, but that is how I feel. There are a lot of honest, starving people in Dafur who should be here before you.

If I were the judge ,yes I just might under many conditions.Being a drug addict is very serious and you know yourself you are always one crisis away from starting drugs again.But I would take a chance on you, one more time and as I said under monitored conditions to assure that you were not using drugs again.Its a very good thing that you are raising and supporting your children ,but you don't get anything special for doing what you should be doing anyway.You made them,support them..I wish you luck .I don't think immigration would see it my way tho.

If you've got a Green Card and you've been outside the USA for over 1 year you've abandoned your immigrant status. It's that simple. It's the law. It doesn't matter what I think.

If both your parents were citizens then you are as well by blood (jus sangre) no matter if you were born outside the country

Your question says you left on your own...there is no issue

Where would they deport you to if you were born in the U.S. to U.S. citizens? New Mexico? All I hear in your question is that you're a victim of life. Aren't we all?

you were brought into this country when you were 1, and the interesting thing is
if you had kept your nose clean ( no drugs or crime) you would not be singled out ( most likely) for deportation
