it just a road and it doesn't have to be paved or made of any other material, it just has to be designated by the city, county, state, or federal government as a road(way).

I assume this ties in to the other question you posted about easments so lets expound on "Roadway" a bit.

A road is simply a wide pathway. Black's law dictionary defines it as: "an open way....... a strip of land appropriated and used for purposes of travel and communication between different places"

Roads come in all flavors, dirt, gravel, asphalt, concrete and, in some cases....just paper (dedicated and never created or created and abandoned but still 'of record'). Roads can be both public and private but, in general, improvements of any substance require meeting some kind of general building code.

The nature of a roadway is generally defined by its users however even private roadways must follow the local agency building requirements just like putting up a house or building an addition.

So.. the answer to your question is a profound 'maybe'. You will need to research on various levels to see what is required in your specific situation.
