I agree with the other folks who said to contact an immigration attorney. Many will talk to you for free or for a small fee. Make sure you get someone who specializes in immigration law, preferably someone who is a member of AILA, the American Immigration Lawyers Association.

In order to get a green card, you have to be sponsored by someone. If your husband is a US citizen, he can file form I-130 to get you a visa. He also has to file form I-864, affidavit of support showing he makes enough money (125% of the federal poverty line - $16,500 for a family of two). Normally, you would also file form I-485 (adjustment of status) to claim the green card in the US. If you came into the US on a visa and overstayed, you can still apply for adjustment in the US [INA 245(a)]. If, however, you came without papers, you cannot claim the green card in the US unless you qualify for INA 245(i). If you can't claim the card in the US, you will have to go back to El Salvador. If you have been in the US illegally for more than one year, and you leave the US, you will not be allowed to return for 10 years (unless you qualify for a waiver).

Because the law is complicated, your best bet is really to sit down with an expert and go over your papers and specific situation to see what you can do.

Feels like he has no intention of leaving his wife. His behavior is all in regards to the game and his ego. He is having fun with the validation of all this awareness. First, like with anything you do check as many different lawyers and community org's until you feel that you can make an informed decision. Ask lots of questions. Ask specifically, how your paperwork can be processed without you having to go back to your home country.
I am a citizen and my husband of 10 years, just chose to do his paperwork 2 years ago. He did not have to go back to Mexico, as some said.
The whole process from start to finish took about 6 months. We live in MI, I know that it takes longer in some states. We paid approx. $1,700 for the application fees, medical exam, and lawyer fees.

Just make sure that for no reason you file for asylum if you can't undeniably prove your case.

*** YES YOU CAN STILL BE DEPORTED IF YOU DO NOT HAVE YOUR PAPERWORK IN PROCESS! DO NOT GO TO CITY HALL, OR IMMIGRATION OR ANYWHERE ELSE TO ASK QUESTIONS WITHOUT SEEKING LEGAL ADVICE FIRST!!!!!

Forget about getting respectful answers here!! You should speak with the proper person because on here you will only have to read people's ignorance and worst of all make you feel bad. Good luck and wish the best.

Go back home and get the proper paperwork set up. Do it the right way, instead of the way 20 million Mexicans have done it.

Don't stress so much. Ask someone who actually knows-the immigration department. Check in the phone book and don't be afraid to call. They will help you, not kick you out of the country. You are married to citizen? If you are you won't have to go anywhere. You need to apply for papers here, not in your home country. Good luck Y Feliz Ano Nuevo.

2 choices; One, go back or worry. Two; get an immigration attorney for (free) consultation. Be smart and resourceful or suffer. that's America. thanks
