It is rare, however, you will get sued first, and than you will make payment arrangements with them. If you miss that payment arrangement after you have been sued, that is when they can garnish your wages. But also, i guess it depends on your state laws. Each state is different. Good Luck

Depends on the state law where you reside. It doesn't happen very often, and would very likely not make it through the legal scrutiny of the court. Have you been threatened with this? Depending on the nature of the threat and the debt, the collection agency may have made an illegal claim in their correspondance with you. It's time to check the law in your state and see if you have them by the balls. It's really great to negotiate with a collection agency that has overstepped the law.
