Whats the first thing she has to do to go to court? Does she appeal or jsut pay the fine or will she be asked for papers?

Typically that kind of ticket is not just a pay a fine ticket, it is a fix-it ticket, meaning she will have to get a drivers' license and insurance. If she can't and they find out why, or if they independantly check, she could be asked for papers. It really varies by locality and would have to be her unlucky day, unfortunately.

I think our laws need to be enforced, but the fact is often police have little time or will to do so when a person isn't involved in a fairly serious crime.

I just read carlosp's response. And they ask why we think manyy illegals are law breakers? If it is inconvenient or would cost more, hey, break another law!

Depends on the state. More and more states are notifying ICE (immigration and customs enforcement) when an illegal alien is involved in another violation of the laws.

So if she goes to court, an ICE agent could be waiting for her after she pays her fine.

If she doesn't go to court, then a warrant will be issued for her arrest and the next time she will be arrested. After she serves her prison term she would be turned over to ICE to be deported.

Did she do the crime of driving without a license and insurance? If so, what defense does she have?

The judge will ask her for her license and proof of insurance. If they are dated before her ticket, no problem. If they are dated after her ticket, she is guilty!

If she was to get off (highly unlikely) the police could (unofficially) call ICE if his agency does not allow it.

She could always go back to her country.

Now I pay about $500.00 per year in Uninsured/Underinsured motorist on my car insurance because of criminals like your cousin.

if it was in a sanctuary city they will just drop it probably becuase no cop wants to do all that paperwork, she has to go to the prosecuter before her hearing and be honest,,,If this is in some uppity town somewhere then I would suggest getting other legal advice

the first thing she should do is leave the country and stay out! she is a danger on the roads and an insult to the good americans who pay for insurance and follow the law.

No , She will recieve a hefty fine ( Which she will never pay), Then she will be let go ( Probably drive herself home) . Wash , Rinse, Repeat.

Let the ACLU help. They can get the legal taxpayers to pay for her ticket and she can go back to her under the table paying job. (I hope you can see the sarcasm). Of course she should be deported, along with the 26 other people who live in her two bedroom apartment.

she will have to pay the fine. they will talk to her about making arrangements on how they want her to pay. did they take her vehicle?

your cousin shouldnt be in this country let alone driving in it. you might have some bigger problems.
