Ok, my sister was dating this guy, and they were renting-to-own a house. He made a deal with the land lord that he will pay him money when he gets his lawsuit and his Social Security money for being disable. He signed the contracts and made the deal. My sister never signed a thing. They split up and he moved out last month and my sister has been trying to move out. she finally did it today. :) However since her ex never payed the land lord any money, he is trying to take my sister to court for the money that he owes him.


Question:
Can he do that? What can my sister do?

I think that your sister should contact a lawyer (or similar) for this query. Personally I don't see why she would be responsible for the debt /contract - and if push came to shove I think a judge would agree.
This guy is barking up the wrong tree!

Yes, she can be held liable. If she set up residence in this rent house, then she can be held accountable for the rent or any other payments. Ofcourse, this is a civil matter and it is completely different from any criminal matter. She may have to take her exboyfriend to civil court or make sure he is named in the pending matter as a codefendant.

Can he yes will he be successful well maybe depends on the judge. see when you take residence somewhere the courts look at it as you are responsible for the bills even though she didn't sign anything.

her best defense to it is to play dumb and just say hey heck i thought he paid up front.

If your sister didn't sign the agreement, and the boyfriend didn't have a power of attorney authorizing him to sign for her, then the landlord can do nothing.

If your sister never signed anything - NO CONTRACT, NO MARRIAGE, etc - she should eventually be able to walk without paying.

He can try to collect but it's doubtful that he has a case. In any event, your sis should cosult a lawyer.
