DWI is an older term used, now with so much drugs out there they changed it to DUI...driving under the influence, meaning any substance that has impaired your driving and you were stopped for probable cause....and yes if you get a ticket for DUI you ARE legally drunk......husband is Justice Court Judge

There is no difference in effect, just different ways that states may refer to their laws prohibiting driving after drinking. Probably DUI is the more accurate term, since if the alcohol (or any other substance, including prescription or over the counter medication) has affected your driving in any degree you are violating the law. Additionally, all states have a law prohibiting driving with a blood alcohol level of .08% (and sometimes lower), whether or not your driving is affected. This is sometimes called DWI or DUI, but really is not, since it is irrelevant whether you are intoxicated or under the influence.

DWI - driving while intoxicated
DUI - driving under the influence.

The first is mainly if you have been caught drinking and driving.
The second can be used if you are using any thing that may impair your judgement while driving (ie: medication, ect).

In the state of Texas there is no longer a DUI for adults - only a DWI.

DWI is "Driving While Intoxicated"
DUI is "Driving Under the Influence"

The difference is that in a given state you can only be charged with one or the other, because they are alternate statutory terms for the same thing. Different states use different terms, and though there are slight variations in what "intoxicated" or "under the influence" means, they're basically interchangable terms.

DWI is driving while intoxicated. It means that you are legally drunk
DUI is driving under the influence. It means you have been drinking, but not legally drunk.

There is no real difference one is Driving under the influence, the other is Driving while intoxicated, it can mean any type of intoxication usually Drugs and Alcohol!!
