Beyond that, Federal unemployment (FUTA) taxes are paid 100% by the employer and are paid as part of your employers 940. It must be paid quarterly (I'm pretty sure, though it's been a few months since I worked for a company that asked me to pay them) and are only paid on the first $7000 that you earn. The amount is based on a percentage of the gross salaries they pay out.

If your employer fails to file the taxes in a timely manner, the IRS gets testy and fines your employer heavily. It they continue to refuse to pay, the IRS will close the business down.

So chances are pretty good that your employer is paying them.

There is also a State Unemployment (SUTA) that must be paid and has similiar rules.

The best thing to do is ask them. Unless you are working for a tax exempt organization, they are most likely paying them. States have (at least here in Michigan) another category of organization called Reimbursable employers. Your employer might fall into this category. In that case, they are not paying unemployment tax on you yet, but would be required to do so if you filed for unemployment and won a claim.

Your employer is not going to tell you if they are paying . I found out the hard way after 2 years I was laid off and they have not paid now I have to wait for them to do a payroll audit . You can probably call your local unemployment office an ask them. If they have never paid then there is no way they will "catch" them until someone in the company files for benefits.

Check with your respective state. I know in California, you can call the EDD and verify unemployment benefits. You can get the State Unemployment ID from your last year's W-2.
