creditors with my new address and carried on paying everyone, and after about a year, i asked this particular debt collector (who was working on behalf of barclaycard) for a new payment book and I never heard a thing back from them at all, Now 6 years on they have again sold the debt to another firm. the (cab asked them to write the debt off 12 yrs ago but they refused) what should i do about it, does anyone know where i stand legally, they are asking for 300 pounds to clear the debt, it was origanally a barclaycard account, who wouldn't stand by me when my marriage broke up, etc. and they put it into the hands of a debt collector, and now they have sold it on again after all this time. I really dont know how to go about dealing with it.. I would really appreciate some advice. Thank you.

Offer them 1/3 of the amount due as "settlement in full." Get the agreement in writing before you give them the money. DO NOT give them electronic access to any account.

There is a good chance that the debt is unenforcable if it is over 6 years since the date of default and no court action has been taken during the period.

You may still want to speak to a specialist debt counsellor, many of whom offer free telephone consultations on debt realted issues.

Puffy is right - you no longer owe anything to Barclaycard but rather to the debt collection company who will have brought the debt for about £2.00. They then whack on charges of their own and try to scare you into paying. Ignore the letters or right back and tell them the history and you have no intention of paying. They cant do anything - its too late to take it to court although they threaten it and they have no legal right to enter your property unless you invite them in. Tell them to sling their hook - I would (and have done in the past) xx

This is a case of Phantom debt. If you contact them or pay them it starts everything all over again! Just ignore them. The debt was charged off & you are not liable for anything after that happens. They are just trying to scare you.

well having read some of the answers to this question, other people who have barclaycard accounts are subsidising the bad debtors who don't pay. The debt may be payed off after 6years but i hope all you bad payers can now only receive expensive rip off 30% tick or loan shark payments with a baseball bat for missed missed payments.

Debt collecting firms work mostly by bluff. They've bought an expired debt very cheaply and they're trying it on.

Write to them and tell them that you don't owe them any money and that you'd be quite happy to defend the case in court. If they can't get cash from you straight away, they'll leave you alone.

If someone comes to your door claiming to be a bailiff, ask to see their court warrant. (They won't have one) If they don't go away, remind them that impersonating a court bailiff is a criminal offence and say you're calling the police.

i am not sure all my debts now with a debt management company that reduce the amount you owe and payment is one. Keane Financial Magament Ltd - Vinny Leamy 0161 9626444 used to work for barclays so he can give advice and tell you what procedures they have.

the law states that they have 6 yrs to collect the debt after that the debt is gone but they still hound you for it .dont ever reply to them just throw the mail in bin dont worry about it they cant touch you

good luck. I wish nobody would pay collection agencies. If everybody refused to pay they would be out of business in a year. but that won't happen. It's a no win. if you pay them your fico drops because they report a late payment, if you don't pay them your fico drops because they report a no payment, if you take them to court hey drag it out to bury you with legal fees, its a no win. If you can find out where their office is go by and key some cars. it will at least make you feel better.

Not sure about UK law. I do know however that there are free debt counselling services in the UK that you can get the exact answers you need at no charge.

You can visit one of their offices or place a toll free call.
