I recently got married to a woman fromanother country. We have submitted the paperwork to get her permanent residence status. But, when I took her to take her drivers license test, they said she needed a "green card", or an I-94 that is valid for at least 6mo (I think the max. an I-94 can be is 6mo!!!). So, now we have to wait for at least 9mo for her to take her drivers license test. Has anyone run into this problem here in TX <---since it seems like TX has the strictest laws in this.
Does this mean that a person cannot get a license until after they obtain their PR status? Ridiculous!

the DMV in TX wants more than a marraige certificate.

she entered legally under a visitors visa which expires in late Jan.07. I filed for permanent residents status, but she will not get the green card for at least 9mo. DMV said they need more than a marraige license. Her cousin in GA only needed a form from the social security office (in which we have), but TX DMV said that didn't matter. Nothing illegal about our marraige or her entrance into the US. I just think its BS that we have to wait for so long in order for her to get her drivers license (she has an inter'l one, but my ins. co. will not put her on my car insurance until she has a TX drivers license).

True in most, if not all states. If she isn't a resident yet, and doesn't have the green card showing legal residence, she can't get a license.

It sounds like she did not enter the counrtry on a fiancee visa but some other type of visa. If that's the case, and if her original visa is expired there's a very strong chance that she will have to leave the country until her residency application is approved. As long as she has legal status in the US she can get a license. If TX is refusing to grant a license they must feel that she does not have legal status.

I'd suggest you first consult with an immigration attorney.

If you are legaly married to this woman then you should not need a green card in any state , just show them a marriage license...
