my 16 yr old brother lives with our mom and step father who bets him hes usually a great kid but his older brother (20) found a bunch of cuts and marks from his dad on his arm. Also he is starting to change and mouths off to me and my brother alot more. sould my brother gain custody.

Yes but it will be difficult because of his age. The best way to cut through a lot of the system would be to turn your mother and stepfather in for child abuse and then your brother should offer to take him when he is taken away from him. Social services always prefer to place children with other family over sending them to foster care. If he is changing, is he getting into drugs or alcohol to try to handle the pain, if so would he be willing to stop his usage if he gets out of that situation.

If he does not stop his usage then your brother may find himself with more problems then he had bargained for. Your brother may want to talk to him and make a deal with him before attempting to get custody.

that is a big responsibilty not only do you need to have money but you also need to be supportive and there for him when he has a problem. he will be come your child and that will effect you. but there are also positives, you get him away from that environment and show him that there is someone out there that cares for me and loves me. so you have to decide what is best for the both of you

If he can afford it financially and if he has the capacity to take care of a 16 year old. I say go for it.

yeah u need 2 take ur brother out of that situation call the cops next time it happens
