If your girlfriend is planning on moving to the US, then yes you do need to apply for a K-1 Fiance visa. The US citizen is the one who initially files the I-129F at the Service Center having jurisdiction over your state. Once the Service Center has approved the I-129F, the file will be sent to the Consulate in Canada (either Vancouver or Montreal) and your fiance will then have to attend an interview at the consulate in order to receive the K-1 Fiance visa.

If your girlfriend is with you in the US at the moment, you can still file it now, but your girlfriend will need to return to Canada to finish out the fiance visa process.

Also, it is not true that a Canadian can just come to the US to live without applying for a proper visa as stated by a previous poster. Just because a visa isn't needed to cross the border, does not give a Canadian the right to just live in the US.

She doesn't need any type of Visa...Canadians do not need tourist visas to visit the US, just a Canadian passport...she just comes here, you two get married, then you file the paperwork for her to become a Permanent Resident..Fiancee Visa are for people from countries that need a Visa to inter the US...my wife is Colombian...i thought about doing a Fiancee Visa (it takes at least 6 months and sometimes up to two years to get it done), but she had a Tourist Visa so we got married in Colombia, then she came back with me and we got married in the US...I filed the paper work...and now she has her residency....

Never heard of a fiancee visa. She can apply for a tourist visa. A work visa she will need a sponsor - a business sponsor and also proof of financial support.

Actually you are the one who is supposed to petition for her in order for her to get a visa. visit www.uscis.gov to find out if you can do it while she is present in the country. Good luck.
