The first thing to remember, is that the 5 Precepts (in my tradition they are called the "5 Mindfulness Trainings") are not commandments or rules that if broken can cause eternal harm. They are only precepts to train our minds to live an enlightened and peaceful life.

The third precept about sexual misconduct is vague, but it's intent is simple. Sexual energy is to be preserved as much as possible. It should only be used in certain circumstances, or in the case of celibate monastics not at all. The intent of this training is to discipline the wandering eyes of lust and calm them so as to be concentrated on the present moment. My teacher Thich Nhat Hanh explains it this way:

Aware of the suffering caused by sexual misconduct, I vow to cultivate responsibility and learn ways to protect the safety and integrity of individuals, couples, families and society. I am determined not to engage in sexual relations without love and a long-term commitment. To preserve the happiness of myself and others, I am determined to respect my commitments and the commitments of others. I will do everything in my power to protect children from sexual abuse and to prevent couples and families from being broken by sexual misconduct.

In addition, the Buddhist scriptures do not delineate any difference between homosexual and heterosexual conduct or in the performance of any specific sexual acts. Most Buddhist teachers would leave this up to individual conscience, but I think Thich Nhat Hanh's explication of the Third Precept is a good and simple explanation of what constitutes sexual misconduct.

I hope this helps

Exploiting the passions.

If you are bored or want a pick-me-up, so you go out and look for a lay - that is misconduct under the precept.
