I received a DUI back in October of 2004. I knocked it down to a wet reckless charge and was convicted in January of 2005 in Orange County, CA. Now, my lawyer mentioned I could expunge my record in about 1.5 years. However, I am still on informal probation (3 years) which I heard prevents me from expungement. Is this true? I am trying to start training to become a reserve officer for my local police and this is really hindering the process.

You can get a DUI expunged from your record. But the DUI will always be on your record when anyone does a background ck or the cops run your license but it will say expunged and it can not be counted against you. You can not do it until you are off probation. I do not know about CA but if you have a DUI and on probation you can not join a law enforcement agency in some states

You can petition the court that convicted you for expungement or termination of the probation. Probation needs to end prior to expungement. their may be time restraints on how long after the end of the probation before you are acceptable for participation in the reserve officer program.

You cannot get relief under Penal Code section 1203.4 until you have successfully completed probation. And it is not really an "expungement," it does not disappear, and most importantly the conviction will still appear on your DMV record and can still be used as a prior.

I even have heard of situations the place a be sure replaced into accused of thrashing their toddler by using fact they had a bruise on their shin. while they finally have been given shown harmless, it stayed in a working laptop or computing device and that they nevertheless could no longer get jobs in daycare and what no longer via regulation, whether the day care could take them and ignore it. in the event that they gained't erase rates while somebody replaced into harmless, there is no way you will do away with rates you have been in charge on. attempt shape jobs, a lot of those ought to care much less and pay nicely. After some years bypass a lot of places will ignore it if there are no longer any further rates on you considering. good luck to you.

Its funny, yes you can have anything expunged, from the Publics View. How many are Public and how many are Goverment Employees now. gets kinda useless to pay an attorney $ to do something the HSA overturns the second a Judge says it is done.

Of course NOT, expungements are granted only if an injustice was done.
