Basically i'm wondering thepossible outcome of someone getting charged with conspiracy and burglary. have no prior criminal record and didnt actually steal anything. this is all taking place in San Bernardino County, CA.

A person can be liable for participating in a conspiracy even if the crime never occurred, so long as there was an "overt act" leading to the commission of the crime. A person can be guilty of burglary even if he did not personally commit the crime if he aided and abetted somebody who did commit the crime. The maximum sentence for burglary (if this was a residence) is six years in prison. However, if this person truly had no prior record it is more likely that he will get probation, possibly with some time (less than a year) in jail. (More time could be added for the conspiracy, but usually is not.)

This person needs legal representation, but forget the comment about public defenders. Contrary to the beliefs of some, public defenders ARE lawyers, and usually very well trained lawyers at that, particularly in California. If this person qualifies for representation by the San Bernadino County Public Defender he will be well represented indeed.

I'm not sure of the California Statues but I know here in Nevada that would be an attempted grand larceny and with the conspiracy charge that's 2 felony charges. probably get a suspended sentence of 1-3 years and 5 years probation and community service.

I know I wouldn't want a pd to defend me on those charges, I would lawyer up for sure. just about impossible to get a good job today when your criminal record has you as a thief...

Gather evidence and prove in court that the conspiracy and burglary were not committed. If the defense is not proper, the court will rule and definitely, the accused will go to jail. Thus, make the proper preparations to assail the evidence that will be presented by the complainant.

What i do is get proff u did not have anything to do with it and get a lawyer to help and let them do there job but it might cost you money..
