My first suggestion would be to go directly through your insurance if you have collision coverage (or uninsured motorist property damage which is available in some states.)

if you DONT have this coverage- you have no choice but to sue her in small claims court. This will be a seperate court date from her criminal trial that she will be facing for the accident... and yes if they request your attendance at her court date you are required to go

Go directly to your insurance company. Do not pass go, do not get $200.00....
This is exactly what you have collision insurance for. Your adjuster will handle any recovery of money (if possible) and answer all questions concerning your claim. Unfortunately you are going to be responsible for your deductible. If the other party is a deadbeat you can kiss it goodbye. If not, your company will return it to you when they recieve it from the other party through subrogation.

Contact your insurance company ( hopefully you have uninsured motorists coverage) immediately. The police would tell you if you had to appear.

I agree with la428282 - Contact your insurance company and let them do the work of getting payment from the uninsured.

Good luck

Does it say you need to go? call and ask the court they can tell you. If your insurance won't cover it you're screwed! Sue her to get you're money and even then it could take forever because it will be a civil suit.

If you have insurance just let them handle every thing.

If they get any thing out of it they will give you back your deductible.
