i live in new york and i would say that yes they would be because there would be no reason for them to be closed..i would understand january 2 but everything should be back to normal by the third. nobody can get that drunk that they cant get out of bed two days later

Yes - I could not foresee any reason why they would possibly be closed. Many shops are even open on January 1st, just with abbreviated hours (Malls may open later and close earlier).
