my parole officer is making me stay in san mateo county til my transfer goes through, and he says either stay in a homeless shelter or a rehabilitation place. but my family is in santa clara county where all my support is. why mess up my job etc until it goes through? what are the guidelines on parole and transfers?

your P.O. is the owner of you and you have to do exactly what he says. If you where to go against what he says and he had you arrested for Violation Of Probation then you wouldn't have any leg to stand on if you want to later bring up charges or file a complaint against him. Do what he says and if you have complaints then file those complaints with the necesarry people, but until he or someone above him tells you you can go, just stay where you're at.

Your P.O. has the right to make sure you are doing everything you should. If you leave the county before the transfer come through and you skip he is responsible. The other county has the right to turn down your parole and if you have already moved then your P.O. has to track you down and make you move back to the original county. You failed to mention what you are on parole for. That could have a great bearing on the whole subject too. So the only thing you can do is sit tight and hope that the county you want to transfer to decides to accept you.

Under California law, your parole officer / probation officer has the right to pretty much control your life.

Until Santa Clara County accepts your parole case, your San Mateo PO has the final say on what you do.

You can never leave your old address until your parole oficer tells you it is ok. He must approve everything. every move. The only exceptionsare emergencies like if your house or apartment burned down , but you must immediately inform him/her of your move or intention to move.Some parole officers get a high off of causeing cons as much trouble as possible so it's bes ttopaly by the rules and avoind any confrontation with him which you will lose.

Dude, here's a little secret, don't piss off your P.O. He's the only one you never want to piss off. The reason your not in jail right now, is because your on parole, think about this concept for a minute. And,"permission" from your mom don't count. Your P.O.is the one that gives that. All he has to do is hit "speed dial" on his"bat phone" and next thing you know is your waiting for the "violation investigation" to finish, from the "greybar hotel", and all he has to do is "suspect", and your screwed. By the way,if your "rules" say "you can't leave the county", telling a judge that "it didn't say I couldn't work", will probably get you more time. Know what I mean?

yes, you have to do as they say no matter what or you will be considered violated! Don't violate or you won't get to see your family or your job! These guys will run your life and they expect you to put them first. Stay in contact constantly, keep talking to them, that is there job to stay on top of your issues only they have so many other files these days, they hardly ever make it out to your place when they say they are coming (due to possible arrests prior to visiting you at your place, etc.) So if you keep on them, they will get it done, but be patient, I know it sucks to wait! But you just have to!

You have to abide by what the parole officer says. His orders come from the court. Talk to the judge that heard your case.

having been in your place in Cal. they (PO) are the father and mother over you, and theirs isn't a danm thing you can do about it. He may be waiting to see if your given the green light or not. be thankful your not required to keep a roof over your head.

Yes, you can not move without his approval. Untill it goes though he is not valid, and could be denied for various reasons

not sure but believe he can make you stay there until it goes through.
