she didnt file all her taxes from 05 because it took a while getting all the w2's so filed & claimed 1 child. this year she didnt work at all but has to file the rest for 05, since she had another baby can she claim them both when filing for 05. and since i was the only one to work in 06 can i file and claim both kids

Your wife needs to amend her 2005 return to include her missing income. If the second child was born in 2006 then it will not be claimed on the 2005 return even if the child was born before the filing deadline.

If you were the only one to work in 2006 then it makes no sense for your wife to file alone since she will not have any income (unless there is a lot of unearned income, which you didn't mention). If your wife had no income then she is not required to file at all.

You can file alone and may be able to claim both children in 2006. You can claim them if you lived with them for six months in 2006 (or since birth if the child is less than six months old). If you did not live with the children, but your wife did, she will have to agree in writing to allow you to take the exemptions.

Whether you lived together or not, you are allowed to file a joint return with your spouse. If you agree to file jointly, you can amend the 2005 return to a joint return, and/or file together for 2006. This may result in less tax owed, or a greater refund.

she has to file married but separate for 2005, for 2006 you can file as jointly or separate your choice of who gets to claim which kids. I would recommend filing joint in 2006 and try and amend your 05 taxes with her on there. You should speak to a professional for an accurate and maximized tax return.
