You have two choices now: Married seperate or married joint. I would suggest married joint. Most tax programs have a MJF/MFS comparison. Most people benefit more from MFJ.

You should file MFJ if you got married in 2006. Even if you got married on 12/31/06, it's joint, because that is what you were at the end of the tax year. Most of the time it is more beneficial to to do MFJ than MFS. The only time you use MFS is when you are no longer together, etc but you lose out on a lot of tax benefits that way.

You always have the option to file either seperately or jointly....typically it is in your best interest to file jointly, UNLESS one of you brought outstanding tax debt into the marriage...best advice is to get professional advice....usually given for free, from any tax preparer such as Jackson Hewitt, H & R Block, or a private preparer of your own choosing.

Your options are filing jointly or as married filing separately. Joint filing almost always is better for you financially.

in the event that they are not married and are submitting a joint return, this is tax fraud. someone-friendly regulation marriage is a valid marriage for tax applications, yet CA would not comprehend person-friendly regulation marriages - maximum states do no longer to any extent further. if your mom and dad shriveled someone-friendly regulation marriage someplace that it grew to become into referred to as criminal on the time, they had be grandfathered, and okay to document joint. yet person-friendly regulation marriage demands thus lots extra suitable than basically residing at the same time for some volume of time. Assuming they do no longer seem to be married, specific your father ought to amend. He ought to in all probability declare your mom as a based for years while she wasn't working. He could no longer declare head of kin in keeping with claiming your mom, yet while he's your organic and organic father he ought to for years while he claimed you. The IRS kind for amendments is 1040X. there's a place on the kind to describe why the replace is being made.

You can file "Separately" but usally it is better to file "Jointly".

Run it both ways and find out.

Better answers will follow since I am not American, but I would think that this year you could file as individuals and the one with the higher income claim the spousal deduction.
