and it has been on there for 5 years and the verdict is not in my favor, will the date of last activity for this start over from now? If it is going to drop off in two years, I'm tempted to let it be. But, I don't think it is right so maybe I should fight it. I would hate if it started over and I'm stuck with it for another 7 years. I don't know if a dispute counts as activity.

If it has been there for 5 years, don't do anything. It is at most going to be there for another 2 years. If you dispute it, it will not change your FICO score, and could inadvertently support the creditors claim.

There is very specific language in the credit field. If it is really important for you to challenge it, find a lawyer who specializes in this to write the dispute.

When you dispute a charge and the matter is resolved in your favor, the item will never appear on your credit report. No one would even know that you had ever disputed a charge. The only time a credit bureau would show a notation related to a credit card disptue is when the decision was not made in your favor. Even then, usually the only way it would show was if after you were ruled against, you continued to dispute the charge. This usually entails writing back in after the dispute was resolved. At that time the card company would flag your credit bureau. This is not even something negative for you. All tihs means is that when someone pulls your credit report, they will see that the particular credit card account is in dispute. This is helpful when you have not paid the disputed charge on the account. This protects you as a consumer in that if you choose to not pay the charge at least whoever is pulling the report will know that it is because you disagree with a dispute on the account, not because you are late or cannot manage your debt. I've disputed several items on my credit report and the last activity never changed.

Let it be and fight it after it drops off. Then if you aren't victorious it won't appear on your Credit Report.
