Ok, so me and my boyfriend have a baby girl who is one year old. I want to know how I can make sure that she will stay with me if me and my boyfriend break up. I want it to be where she stays with me and he cannot do anything about it. I dont even want child support money from him. I am currently going to school and living with my parents. What can I do to make sure my baby girl stays with me? Please help!

You can't be sure.
If you can prove that he is unfit, you may be able to prevent visitation, but that will be only if you can show that he is unable to care for your child or poses a danger to her well being. There is a good possibility the court will still award him supervised visitation. You can't just cut a parent out of a child's life, most states consider that to be unhealthy for the child, unless the parent in question is a danger to the child. Being the mother, there is a good possibility you can fight for physical custody and win, but, it depends on you and your b/f's seperate living situations. In Ohio, I'm not sure if it is everywhere, you would have to find someone to adopt your child (a new b/f or husband), and your current b/f would have to sign away his rights as a father to avoid paying child support and his rights to visitation/custody. Otherwise, the state could actually file for him to pay child support, even if you don't want it. That doesn't always happen, but it can.
Also, keep in mind, that custody and child support are NOT the same. He can pay child support even if he has no visitation. And, even if he were in the rears paying child support, he would still have his right to visitation.. depending on how the courts rule.
Either way, courts are expensive... and, from personal experience, if it's just that you hate your b/f, and aren't afraid for your daughter's well being, sometimes it pays to be cooperative. Always think in terms of your child's best interest, not yours. Good luck!

Good and bad here. The good; chances are you will be awarded custody if you can give the baby a good and nurchiring home,like your parents. The bad is if you have to go to court over this,chances are the judge will award support with custody but may also award the father visitation rights in exchange for support. You probably wont have a choice about support or visits,but view the money for your daughter for offsetting raising costs. Good luck

now a days when a mother has a child, they automatically get custody. if u guys break up, u go to court and the judge will take a lot of things into considertion. The main thing is, who can provide the best home for the child. He is the father and he does have some rights, but most of the time, the mother get's custody of the kids.

Be the first one to apply for custody, ensure you are giving her a safe and happy home and can meet all of her needs. Perhaps if you dont let it get messy - as in do let the dad see her regularly - there wont be a case that needs to be determined by the courts. If you can be civil then the easier it is. Good Luck It's not easy raising a child on your own....:o)

As long as your a good mom and have help ,aka parents , no court is going to give a baby to it's daddy. If you want him to not have visits, well, that's hard, he would have to unfit.And you really don't want to get a mess started with that, trust me, Go to a probono lawyer and talk to him or her and see what they say. You may have to file some type of paper saying something. But In my divorces ,no man has gotten my kids, just joint custody, and my 1 st x ,he is a drunk and the law knows it, he is unfit and he never wants to see the kids or pay support, and as to my 2nd x , he came every two weeks and would keep her over night.And paid support right on time.So I say just go talk to a lawyer ,or just do it, he can't just take I don't think, but every state is different with it's laws.
