You really should return to your country and apply for the K-1 fiance visa. If you marry and stay in the US, you could run into problems when you try to adjust status because notation in your passport.

The CBP officer obviously felt that you were intending to use the visitor visa to come to the US and stay which is illegal. When you adjust status from a visitor visa because of marriage, the burden of proof is on you to prove to USCIS that you had no intentions of coming the US to marry and stay, looks like that would a difficult thing for you to prove.

You can get married here or return to your country and apply for a fiance visa. It really does not matter because you are already here. even if you are to file for a relative petition after you have overstayed, you were still admitted to the U.S. through inspection. You have two options, stay and file I-130 or go back and file I-129F. If you are in doubt or would like assisance visit www.crystalibarra.com

It's best that you get married here, as long as you can prove that you had a real relationship(pictures, letters, joint bank accounts..etc.) and did not get married strictly for US citizenship, they won't deport you. Unless he can go to your country to get married.
