police report was comments from the guy who hit my car only. parked still in private driveway. engine off ,no one in my car ,he was backing out of shared driveway.

If you go directly through the at fault drivers policy (they must accept liability and have coverage) you will not owe a deductible.

If you go through your own policy you will owe your deductible.

To add to what the previous person said...if you file with your own insurance company, it will depend on your coverages and what state you are in...if your company pays damages but decides to subrogate (go after the other guy's insurance company for restitution), if you have paid your deductible, it will be reimbursed.
