My boyfriend and I moved in new apt. 4 months ago.On the very next day we heard a noise coming from the apt above-running all over the apt all day long.We didn't pay that much attention but the next day it was the same.I came up and told the woman that they're very noisy and annoying us every day and she said i can't do anything-it is my child.I spoke to the super and he told me people before us had complained too and nothing's changed.I spoke to the landlord about that and he told me that the problem is they don't have a carpet.The lease says everybody must have a carpet.Then they started to make even more noise-dragging someth on the floor,banging,dropping heavy objects.Our life turned into a living nightmare.There's noise even after 11pm.These morons don't care about anything and use their child for excuse.We understand they have a right having a child but do they have a right to ruin our life.I wrote a letter to the landlord with asking him to evict these people.Pls give me advice.

Call the Police tell them your neighbors are loud, disturbing the peace. Maybe theres a party going on, you don't know you can't see in there. Call the Police once thru the week, then call again on the weekend around 11p.m.. Start again the next week. Finally the mother (if it is the child) will settle the child down. It's obvious their not concerned about you resting, so give them a little dose of their own meds.
Talking to the noise maker did nothing, the landlord nothing (they are still there making noise, not evicted), go to the next step, Call The Police, finally, start all over again. Noise Maker-Landlord-Police. Finally they will stop. Show them you mean business !!

You might want to ask your local police department about noise laws. Some communities have limits on how much noise after 10 pm and before 6 am (week nights) people can make. If your community doesn't have noise limit laws, your only choice is to move and state in your lease termination notice that neighbor noise is the cause. You may be able to break the lease as it appears that management failed to have them install carpet or allowed them to remove carpet.

1) send a certified letter to your landlord and the property management company informing them of your complaint against your upstairs neighbor about the noice
2) keep a log of every time the noise becomes too loud. time and date.
3) inform your landlord that since he is the owner of the property, and he already knows that there is no carpet within the unit upstairs, that by law, he is supposed to fix this problem. He alreayd knows about, and if doesn't show due diligence in correcting it, you can submit at letter that you will be breaking your "lease" due to breach of contract on his part.

Get a lawyer to help you with hte details.

Speak the landlord, send a certified letter to the managment company, and if nothing changes - move.
