If you plan to leave the U.S. permanently then you would be abandoning your Legal permanent residency. After 12 months you will loose your LPR status. If, in the future you wish to apply for a non-immigrant visa, you would have to file for I-407 (abandonment of LPR) before filing for a non-immigrant visa. If you are planning to return within the next two years (less then two years) then you can apply for a re-entry permit and file form I-131 (application for travel) and you will not abandon your LPR. It really depends on what your circumstances are and If you are in fact willing to abandon your Permanent residency! So once again, if you don’t mind loosing your permanent residency that will lead to U.S. citizenship with full rights! Then follow the first scenario. If you wish to keep your Permanent residency then make sure that you follow scenario 2.

One other thing, the chances of you getting your non-immigrant visa in the future will depend on the circumtances at the time you apply!

Good luck

no longer something he can do for her. He can't petition for a green card for her till he's a citizen. Having a 10 12 months customer visa would not enable her to stay here for 10 years. If she overstays the time she grew to become into given while she entered, she would be deported at any time. Love how human beings basically come to a determination what regulations they desire to maintain on with..."she has desperate to stay"...and then assume to be rewarded for that with a green card or citizenship. She would not ought to stay interior the U. S. because of the fact she is ill, her residing house usa has scientific care. She has to pass residing house if she ever hopes to get a green card interior the destiny.

I dont think you should have a problem obtaining a tourist visa if you give up your residency. It's not liek you are in the country illegally. I know a woman who did just that and went back to Sweden. She visits the USA on occasion.
