That's for the Senate to decide if the House impeaches him for it. But the oath reads, "I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States." You notice how it's an oath to defend the Constitution and not the country per se. Some might make something out of his signing the USA Patriot Act, which we are told limits rights guaranteed by the Constitution. The way the war is being prosecuted--no declaration of war, no Congressional oversight--is out of line with the Constitution and might be seen as a violation. There are probably lots of ways to say he has.
