My car was towed on a saturday morning. The sign on the street stated no parking between 7am to 9am and 4pm to 6pm mon threw friday and no paarking when snow is over 2 inches. There was no snow no snow on the groud. I paid and got my car out the pound 160.00. I requested for a hearing. When i went to the hearing the judge favored in the citys favorite because on the next block on the same street there was a sign that was posted that stated between december 1st and april 1st no parking between 3am and 7am. They told me i can appeal within 35 days by filing a civil law suit. Is there any thing i can do. Please let me know.

You can file the civil lawsuit, but it might have to be in small claims court and you will need evidence to win your case.

Appeal and lawsuit are two different things.

Filing an appeal is requesting the evidence be reexamined to determine your culpability. Suing is when the appeals process has been exhausted and still against you or when your rights were violated.

Take photographs of the area and all the signs forward and behind where you were parked. In my city, the signs are for that block only. Crossing the street is a whole new set of signs. Also in my city the sign at the beginning of the street,(if the regulations are more stringent) will override the rest of the street.

From what you are saying, you have an appeal. Set up a hearing and make sure you have the documentation. perhaps a sign was broken or missing. Investigate if a sign was replaced after you received the ticket.

well you can surely sue them if you like--ill tell you though--it will cost you more money in the long run if you have to hire a lawyer--then that attorney will have to get transcripts of the court hearing that you had where the judge ruled against you== so--before you know it you will have spent more money and time on this then its worth== ou must realize that the system is set up this way and Judges are not fair at all when it comes to these things--but they get away with it because they know you will go no further when you find out the monies it will cost--a transcript alone can cost you hundreds of dollars..see what i mean?? perhaps something should be done about-judges being fair

Sure, you can sue the city. How much you are willing to spend is up to you. If you have the knowledge to do it yourself, go for it.
