Section 274 felonies under the federal Immigration and Nationality Act, INA 274A(a)(1)(A):
A person (including a group of persons, business, organization, or local government) commits a federal felony when she or he:
* assists an alien s/he should reasonably know is illegally in the U.S. or who lacks employment authorization, by transporting, sheltering, or assisting him or her to obtain employment, or
* encourages that alien to remain in the U.S. by referring him or her to an employer or by acting as employer or agent for an employer in any way, or
* knowingly assists illegal aliens due to personal convictions.
Penalties upon conviction include criminal fines, imprisonment, and forfeiture of vehicles and real property used to commit the crime. Anyone employing or contracting with an illegal alien without verifying his or her work authorization status is guilty of a misdemeanor. Aliens and employers violating immigration laws are subject to arrest, detention, and seizure of their vehicles or property. In addition, individuals or entities who engage in racketeering enterprises that commit (or conspire to commit) immigration-related felonies are subject to private civil suits for treble damages and injunctive relief.

We should be stopping them at our borders. I'm not normally a conspiracy theorist, but I do believe there is a conspiracy regarding illegal immigration between our government and other governments that undermines our very sovereignty. They'll throw a U.S. citizen in jail for smoking a joint or not paying a ticket, but (from personal experience) when an un-insured illegal rear-ends someone and tries to run causing great bodily injury and totaling a new truck, or breaks into our country illegally, our current officials say there is no recourse and no remedy... they are not even questioned... Employers are only the cause and the beneficiaries of the circumstances, the government is willfully at fault.

Illegally immigrating is not right. However, the government has to follow some steps in restricting hiring illegals.
The primary reason for increase in crime rate in illegal residents is because when illegal residents cannot find work, or won't be given work, they resort to other ways of getting money, including drugs, car jacking, theft and so on. I mean get real. If no one gives you work, what would you do.
So before the governement can do this, they should do something either to identify the illegals clearly (there is not straightforward way to this) so that they can either be sent back or given proper workers permit , so they can work legally.
Just shutting them off, will only increase crime rate.
After this is done properly, if the employers still hire illegals, they can penalize the companies by imposing suitable fines. If you send the company officials to jail or shutdown the companies, it will only create more economic problems for the country.

Three ttimes the salary they were paid to begin with, along with 5 years of probation. If they consistantly violate the probation, just close them down altogether.
