I lent my brother 500 dollars, he said he needed it because his car broke down, and at the time did not have the money.
It's just us two in our own house, and since we both work, I was confident he would be able to pay me back.
I let him know from the start I needed it back ASAP, as we both spilt the bills.
I later found out that he used it for illegal purposes.
I need this money back, and do not want to take him to a court because he is my brother, and he also used the money illegally, and do not want him or myself to go to jail..how can I get it back?

That's a tough situation. Tell him you want him to start giving you a certain amount out of every check. He may not be able to come up with the lump sum, but installments may be workable. If the illegal purposes was drugs, you're gonna have a heck of a time getting it back. Not worth taking him to court over. I never lend money to family if I know I cannot afford not to get it back. It prevents hard feelings.

Ever heard the saying, "Never a borrower nor a lender be" in other words when you loan then you have to do it with the knowledge that you may never see it again. You could go to small claims court but I agree with you, the courts don't need to get involved with family situations such as yours. Just keep asking and never lend again. Probably you should kiss the $500 goodbye and say you've learned a lesson.

well you should take the matter to a small claims court that's what they are there for, it's nothing personal, just a business matter whether he is your brother or not and you don't have to point out that he used it for illegal purposes, no one will end up in jail

Forget it... did he buy drugs?
In that case, you are out the money and one of you should be looking for another place to live.
If he is involved in illegal activity, you are at risk of losing everything, if your house gets raided.
Lesson Learned...
1. Never loan money you can't afford to lose.
2. NEVER loan money or do business with a family member.

Well, if you want your money back that bad sweetie... you are going to have to take him to court. There really is no other way, unless he decides to give it to you in your hand.. which unfortunately has not happened yet. If you take him to court, you will have to have proof you gave him the money, because he could say you did not give him anything... your word against his!! Good Luck!

Conjure up a similar excuse like he did and ask for money. That ways you will have your money back. You will have to be innovative and take care you don't give him any next time.
Second option could be to take some of his belongings and auction them to recover your money.

you don't loan money to a family member; you give money to a family member. period.
if your brother has done something illegal encourage him to take the matter to the local police, he may be able to get a better deal.

trust me....when you say illegal purposes i assume you mean only one thing.if he has the addiction you will never get it back whatever you choose to do. consider the money a loss and never lend him money again.good luck and do hope he gets himself some help.
