i'm dealing with this guy and he says he wants to be with me but he also tells me that his son's mother wants them to be a family he tells me it's not like that but i beg to differ..when i call he never answers at a certain time then he always calls me around 1 or 2 in the morning...like nothing never happen

Honestly, and because I was once in your situation, the best thing for you to do is to get out of that relationship while you are still ok... you can be friends with the guy but that's all.
It seems that like my ex, he wants to have his cake and eat it too.
He's being upfront about it so that you can't say that you didn't know about it.
He's gonna try to blame you for it and say you knew what you were getting into.
