Who specifically is threatening to sue you? Is it the credit card company or a collections company? The credit card company will charge it off after 120 of you don't pay within that time period.
After that a debt collections agency generally purchases your debt for about ten cents on the dollar. They then use any and all tactics available to them to profit from their investment in your debt. As long as they make more than the .10 they paid on each dollar of your debt, they come out ahead.
If a collections company threatens to take you to court, do not be scared! Realize that they cannot legally prove that you owe them anything--cause you don't! Most folks just pay them out of sheer ignorance and fear. Do not fall for it. If a collections company takes you to court--GO! They are counting on your being so afraid that you cave in & make payments to them. That's how their company prospers and the collectors make their commissions.
But if the debt has been charged off, why would you pay it off again to someone you do not even owe it to?
The game is so old...SWITCH the script on them.
Go to court.
When the judge asks you how much you owe the collections company, you can HONESTLY say, "Nothing, Your Honor."
The burden of proof is on them to prove that you owe them anything. They will not be able to produce any documentation stating that you owe them a dime--cause ya DON'T!
"Case DISMISSED!"
Next you will need to begin getting your GOOD CREDIT back in order and prevent yourself from ever being in this predicament again.

how much is it for, offer a payment plan. How long was it for? if it has been like 5 years and a collection agency ownes it. you go to court and file a motion of discovery. This will make them bring all documents supporting the debt. Most of them don't have them so they will loose. get a lawy er if this is the case. Now if is a resent and it is still owned by the credit card company call them and work on a payment plan.

You MUST see a Lawyer, Legal Aid, Preferably a Lawyer,If you have access to Legal Aid,they will PROVIDE you with a Lawyer. The Lawyer will get onto the Company IMMEDIATELY, Back them OFF, if your Credit company is harassing you your Lawyer will stop this! Do not return your card!!! OR USE YOUR CARD in any way!!!!! The Legal Aid/Lawyer will take things away from your Credit Card & make sure the matter is placed in the control of a det-collector and Negotiate with you on your behalf.AS to how MUCH YOU can afford to pay them off!!!,Please try not to have another Credit Card as they are scamming people,especially now they have turned to "Call Centres"They sound irresisable at the time,easy to use,& often are just sent to you Out of the blue!!! Unless You have applied yourself for your card? If the Credit Card company is constantly phoning you,let your Legal Aid/Lawyer know,All You Have to say is: "It's in the hands of my Lawyer,Do NOT bother me again OR my Lawyer Will Have You for Harresment, Don't let them ask any other questions,be firm and say GOODBY"!!!! Then get back to your Lawer re:Harrasment,which will go in your favour,another words,YOU DO HAVE RIGHTS TOO!!! Good luck,and do not take out another Credit card Untill You Read the FINE PRINT!!!!

Call them and make arrangements to pay. Most credit card companies will help set up a repayment schedule that fits in with your income and expense needs. I would also suggest that you stop using the credit card and only pay cash until you get this sorted out.

Call them and set up a payment plan before they sue you. If you keep failing to pay, you will keep adding to the bill with interest charges and they will report you to the bureaus.

they can not sue you they can't do anything but write off or charge off your account no need to worry them saying they are suing you is their way of threatening you to pay
